SURFERS MEMBER TERMS & CONDITIONS

Surfers Paradise

1. Information on how to enter the Surfers Member promotion forms part of these Terms and Conditions of entry. By entering into this promotion, the entrant accepts, and is bound by, these Terms and Conditions.
2. The promoter is Surfers Paradise Alliance (the Promoter), PO Box 279 Surfers Paradise QLD, (ABN 19 097 068 285).
3. The promotion commences at 6am (AEST) on Friday 27th August 2010 and ends 10pm (AEST) Monday 13th September 2010 (the Promotion Period).
4. Entry is open only to participants who register a vote during the Promotion Period to participate in the promotion (Eligible Entrants) and excludes directors, officers and employees of the Promoter.
5. The promotion will be marketed on radio (Hot Tomato) and online (mygc.com.au, goldcoast.com.au and surfersparadise.com).
6. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated address in order to claim their prize.
7. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:
1. Visit www.surfersparadise.com.
2. Register to become a Surfers Member by completing the online registration form.
3. Submit the entry online.
4. Note: the entry form does include opt-in permission based marketing.


8. The prize draw will take place Wednesday 15th September 2010 at 10:00am, at Level 3 Surfers Paradise Transit Centre, 10 Beach Road, Surfers Paradise, QLD 4217. The winners will be selected at random from the list of Surfers Surfer members.
9. The result of the prize draw is final. The Winner(s) will be notified by telephone or email on Wednesday 15th September 2010(as above), at 11:00am.
10. The prize is as promoted and no substitution is allowed. There is two (2) prizes of a $1,200 42" LG Plasma Televisions and three (3) prizes of a $500 Oakley prize pack. Total prize value is $3,900.
11. The Promoter accepts no responsibility for any variation of the value of the prize.
12. The Prize must be taken as promoted or it will be forfeited.
13. The Prize is not redeemable or exchangeable for cash.
14. If, for any reason, the promotion is cancelled due to any one of the following: infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and cancel, terminate, modify or suspend the promotion.
15. If an act, omission, event or circumstance occurs that is beyond the reasonable control of the Promoter and prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to applicable law) to cancel, terminate or modify or suspend this promotion.
16. The Promoter, its directors, officers and employees, related bodies corporate, and their respective officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this promotion, the marketing of this promotion or use of any prize, except for any liability which cannot be excluded by law.
17. The Promoter reserves the right to re-draw the winner in the event of the following: (i) breach of these terms and conditions; (ii) forfeiting a prize or (iii) not claiming a prize or (iv) inability to contact the winner.
18. If the Prize has not been claimed by Wednesday 22nd September 2010, a re-draw for the Prize will take place at Surfers Paradise Alliance at 10:00am AEDT on Thursday 23rd September, 2010, subject to any written direction of State or Territory lottery authority. The re-draw prize winner will be notified by telephone or email on Thursday 23rd September, 2010.
19. The Promoter will oversee the registration process and the total number of registrations received for any of the nominees or finalists will not be disclosed.
20. Entry details remain the property of the Promoter. The name and photograph of the winner of the promotion may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Eligible Entrants consent to the Promoter using and publishing and disclosing to its agents, contractors and entities associated with this promotion personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes.
21. Any personal information an entrant submits is solely for the use the Promoter. It will not be sold nor given to any third party not associated with the promotion. Entrants will not receive any unsolicited information from any company unless entrants indicate otherwise in the registration forms.
22. The Promoter is not responsible for the delivery of the prize to the winner. The Prize must be picked up by the winner or a nominated authority from Surfers Paradise Alliance, Level 3 Surfers Paradise Transit Centre, 10 Beach Road, Surfers Paradise, QLD 4217.
23. Surfers Paradise Alliance is not responsible for any faults or damage in relation to the prize once it leaves the Surfers Paradise Alliance premises, Level 3 Surfers Paradise Transit Centre, 10 Beach Road, Surfers Paradise, QLD 4217.
